If your product is designed or intended to be played with exclusively or otherwise by a child aged 14 or under then it is legally defined as a toy.

This also includes products that are designed to be played with the child in the presence of an adult.

You are required to UKCA/CE mark your products – continue to the next step – risk assessments!

If your product is mounted into a frame, for the purpose of wall hanging or a picture frame for a table top – it is defined as home décor and does not require testing as a toy.

If your product is intended to be used exclusively by adults and is advertised as such with your branding and marketing; is a collectable item, or has a price point that would normally not be associated with a children’s toy then you would not need to test them.

If your product is designed to be played with by an adult and their children, this is still classified as a toy and you are required to UKCA/CE mark your product – continue to the next step – risk assessments!
